1. Introduction

Welcome to Finistry. These Terms of Service ("Terms") govern your access to and use of the Finistry website, mobile applications, and services (collectively, the "Service").

Finistry is operated by a company currently in the process of registration in the United Kingdom. Once registered, full company details will be published.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

To use Finistry, you must:

  • Be at least 18 years of age
  • Be a resident of the United Kingdom
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable law

4. Service Description

Finistry provides AI-powered financial management tools for UK self-employed individuals, including:

  • Expense tracking and categorisation via Open Banking integration
  • Real-time tax estimation for Income Tax and National Insurance
  • CIS (Construction Industry Scheme) deduction tracking
  • Rental income and property expense management for landlords
  • Receipt scanning and document storage
  • WhatsApp assistant for accounting queries
  • MTD-ready digital record keeping

5. Early Access Program

Finistry is currently in Early Access. By participating, you acknowledge that:

  • The Service is under active development and may contain bugs or errors
  • Features may be added, modified, or removed without notice
  • Service availability may be interrupted for maintenance or updates
  • Early Access pricing is promotional and may change upon general release

Your feedback during Early Access helps us improve the Service and is greatly appreciated.

6. Subscription & Payment

6.1 Pricing

Finistry offers monthly and annual subscription plans. Current pricing is displayed on our website. All prices are in British Pounds (GBP) and include VAT where applicable.

6.2 Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). Your subscription will automatically renew unless cancelled before the renewal date.

6.3 Payment Methods

We accept major credit and debit cards. Payments are processed securely through our third-party payment provider. You authorise us to charge your payment method for all fees incurred.

7. Refund Policy

We want you to be satisfied with Finistry. Our refund policy is as follows:

  • 14-day cooling-off period: You may cancel within 14 days of your initial purchase for a full refund, in accordance with UK consumer rights
  • Annual subscriptions: Pro-rata refunds may be available at our discretion if you cancel after the cooling-off period
  • Monthly subscriptions: No refunds for partial months; your access continues until the end of the billing period

8. User Responsibilities

When using Finistry, you agree to:

  • Provide accurate financial information
  • Review and verify all tax estimates before filing
  • Maintain your own records as required by HMRC regulations
  • Comply with HMRC record-keeping requirements
  • Use the Service only for lawful purposes
  • Not attempt to reverse engineer or copy the Service
  • Not share your account with others

9. Acceptable Use Policy

You must not:

  • Use the Service for any fraudulent, illegal, or unauthorised purpose
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the integrity of the Service
  • Use automated systems to access the Service without permission
  • Resell or commercially exploit the Service without authorisation

We reserve the right to suspend or limit access to the Service if we determine, at our sole discretion, that your usage is excessive or abusive and negatively impacts the Service for other users.

10. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by Finistry and protected by intellectual property laws.

You retain ownership of your data. By using the Service, you grant us a limited licence to process your data solely to provide the Service to you.

"Finistry" and our logo are trademarks. You may not use them without our prior written consent.

11. Third-Party Services

Finistry integrates with third-party services to provide functionality:

  • Open Banking providers: To securely access your bank transaction data with your consent. Open Banking access is provided strictly on a read-only basis and only for the accounts and period you explicitly authorise.
  • Payment processors: To handle subscription payments securely
  • WhatsApp (Meta): To provide our chat-based assistant service

Your use of these integrations is subject to the respective third-party terms. We are not responsible for third-party service availability or changes.

Finistry is a financial management tool, not a tax advisory service. We do not provide tax, legal, or financial advice. Finistry is not authorised or regulated by the Financial Conduct Authority (FCA) and does not provide regulated financial or investment services.

  • Tax estimates are for informational purposes only and may not reflect your actual tax liability
  • AI-generated categorisations and suggestions should be reviewed by you
  • AI-generated insights are based on the data provided and available integrations and may contain errors or inaccuracies
  • You are solely responsible for the accuracy of your tax returns filed with HMRC
  • Always consult a qualified accountant or tax professional for specific advice

The Service is provided "as is" without warranties of any kind, express or implied.

13. Limitation of Liability

To the maximum extent permitted by UK law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for losses arising from incorrect tax estimates or filing errors
  • We are not liable for third-party service failures or data breaches beyond our control

Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

14. Indemnification

You agree to indemnify and hold Finistry harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

15. Termination

15.1 Termination by You

You may cancel your subscription at any time through your account settings or by contacting us. Your access will continue until the end of your current billing period.

15.2 Termination by Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion with reasonable notice.

15.3 Effect of Termination

Upon termination, your right to use the Service ends. You may export your data in a commonly used format before termination. We may retain certain data as required by law or for legitimate business purposes.

16. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last updated" date at the top
  • Notify you via email or through the Service
  • Give you reasonable time to review changes before they take effect

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If we cannot resolve the dispute, you may be entitled to use alternative dispute resolution services or bring a claim in court.

19. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Finistry
  • Severability: If any provision is found invalid, the remaining provisions remain in effect
  • No Waiver: Our failure to enforce any right does not waive that right
  • Assignment: You may not assign these Terms without our consent
